The UK Border Agency's decision to withdraw London Metropolitan University's licence to accept non-EU students has meant the suspension of study and threat of deportation for 2,000 international students, and financial crisis for a university already struggling to stay afloat. The agency's justification is London Met's "systemic failure" to account for the immigration status of its international students. But why has the survival of a university, whose raison d'?tre is to educate, come to depend on its ability to control the UK's borders?

One London Met lecturer has written anonymously claiming of his institution that: "This is not a university that is run well. The UK Border Agency basically says as much." Is this what higher education has come to? That people allow an agency that has nothing to do with education to judge whether or not a university is "run well". She/he hopes that the agency's decision will mean the elimination of those students whose English is not up to scratch. Rather than cutting them loose, the solution to students struggling with English skills, whether home or international, is to provide them with extra support ? difficult of course in a climate of budget cuts, but not impossible, and my own university is testament to this.

It is obscene that those students already in the UK at a well-established institution will be uprooted from their homes and have their legitimate expectation to complete their studies dashed.

The agency's move has been criticised on a number of fronts, seen as part of a wider attack by the coalition government on education institutions already suffering the effects of hikes in tuition fees and cuts to public funding. A petition calls for an amnesty for the thousands of international students whose studies have been terminated, and urges that they be allowed to complete their studies while "the problems at London Met are addressed". While an amnesty for these students is absolutely necessary, a fundamental perspective is missing from the debate: universities should never have been made to play the role of immigration and border control officials. The role of universities is to educate, not to police.

The sponsorship system devised by the border agency permits universities to accept international students on to their courses on condition that they enforce immigration controls. According to the agency, the system is based on the principle that "those who benefit most directly from migration ? help to prevent the system being abused". It seems fair to assume that the agency is alluding here to the universities reaping the economic benefits of international students through charging extortionate fees. But universities should not be in such a poorly funded condition that they have to economically exploit international students.

Of course the true benefit brought by international students is their contribution to the creation of a multicultural environment which enriches the learning experience and expands the horizons of all on campus. But rather than welcome these students, the message from a government fixated on immigration control, spurred on by anti-immigration groups keen to blame migrants for society's ills, is to treat them as suspected scroungers or potential terrorists. Under-pressure university administrations insist lecturers police their classes to prevent those without a valid visa entering, monitor levels of "radicalism" among students, and take registers to record the attendance of international students even where attendance is not compulsory. Such discrimination in the classroom goes against the ethical principles and traditions of academia, sowing mistrust and corrupting the atmosphere within universities.

How convenient then for the government that the debate over the revocation of London Met's sponsorship licence has skipped over the fundamental problem: that government policy treats international students as cash cows and turns universities and their staff into henchmen of its invidious immigration system.

Clinton to hoist US flag in Asia, to China's unease

US Secretary of State Hillary Clinton sets off Thursday on a sweeping Asia tour from a rising China to tiny island states as her outspoken role on the region's hotspots raises hackles in Beijing.

In the midst of a US presidential campaign, the former candidate is expected to steer clear of politics at home and portray Washington as an anchor of stability in a region where China has increasingly butted heads with neighbors.

Clinton will head first to the Cook Islands, an archipelago of just 11,000 people, to become the first US secretary of state to take part in an annual summit of South Pacific islands -- where China's clout is growing.

Clinton will go Tuesday to China, where aides said she will meet President Hu Jintao and other top officials and take up the full gamut of issues between the world's two largest economies, including heated maritime disputes.

In unusually robust statements, the United States has recently accused China of escalating tensions and warned against "divide and conquer" tactics after Beijing set up a remote garrison in the South China Sea.

The Philippines, Vietnam and other nations claim islands in the South China Sea -- the passageway for half of the world's commercial cargo -- and have accused Beijing of a campaign of intimidation.

China's state-run Xinhua news agency accused Clinton of trying to "contain China's increasing influence" and said that the core of US strategy "is to defend its dominance and hegemony in the Asia-Pacific region."

Xinhua had harsher words for Mitt Romney, who is challenging President Barack Obama in November 6 elections, saying that the Republican's tough talk on issues from Taiwan to exchange rates could end up "poisoning" the tone in US-China relations.

During Clinton's last visit to the region in July, foreign ministers from the Association of Southeast Asian Nations failed at a meeting in Beijing-friendly Cambodia to forge a common way forward that would let them seek a code of conduct to govern disputes in the South China Sea.

A senior US official said that Clinton wanted all sides "to abstain from provocative steps" and that she would confer with Indonesia and Brunei on the future of diplomacy for a long-mooted code of conduct.

"She's certainly going to ask in ASEAN about the aftermath of what transpired in July," the official said on condition of anonymity.

Ernie Bower of the Center for Strategic and International Studies said that Clinton's visit -- her third to Asia since May -- was part of an effort to "institutionalize" US presence on the continent, particularly the Pacific.

"One of the enormous motivations behind it is to manage China well, but I don't think it's all about China," said Bower, the director of the think tank's Southeast Asia program.

"There are also a lot of intrinsic benefits for the United States through good relationships, security ties and economic ties" in Asia, he said.

Clinton, who will end her trip at an Asia Pacific summit in the Russian port city of Vladivostok off the Pacific Ocean, will also be confronted by rising friction over territorial disputes between Japan and both fellow US ally South Korea and China.

"I have to say that the recent spate of tensions between Japan and Korea has caused concerns in the United States and elsewhere and we are again urging restraint, calm and statesmanship," the US official said.

The official said that the United States hoped that individual citizens and business leaders could work to create a "21st-century" relationship between Japan and South Korea, whose ties are marred by wartime memories.

The flareup, including a visit by South Korean President Lee Myung-Bak to islands disputed with Japan, has set back US hopes that its two allies would work together in the face of a rising China and uncertainties over nuclear-armed North Korea.

Clinton, who is already the most-traveled secretary of state in US history, will chalk up several new feats on her trip.

Besides being the first to take part in the Pacific Islands Forum, Clinton will become the first secretary of state to visit East Timor, which is still developing after it painfully won independence from Indonesia in 2002.

And with her trip to Brunei, Clinton becomes the first top US diplomat to visit all 10 nations in ASEAN.

A "close call" on more Fed easing

(Reuters) - When Federal Reserve policymakers meet next month to decide whether to take action to boost the economy, it will be a "close call," a top Fed official said on Thursday on the eve of a speech by Chairman Ben Bernanke that has global markets on tenterhooks.

Atlanta Fed President Dennis Lockhart, a centrist voter on U.S. monetary policy, said further stimulus would have some positive effect on the U.S. economic recovery, but cautioned that the costs of such action are not altogether clear.

"If we were to see deterioration from this point - let's say persistence of job growth numbers that were well below 100,000 a month ... or if we were to see signs of disinflation that could signal the onset of deflation - then there wouldn't be much of a question about policy," Lockhart told CNBC.

"But now I think the policy question is, how much will you gain and of course what are the costs in the short and longer term," he said as an annual central bankers symposium kicked off in Jackson Hole, Wyoming.

Financial markets are abuzz with speculation that Bernanke could hint at a third round of asset purchases known as quantitative easing, or QE3, when he takes the podium on Friday - and that Fed policymakers could adopt the plan at their September 12-13 meeting.

The Fed in late 2008 slashed interest rates to near zero and has bought $2.3 trillion in assets in an unprecedented drive to revive the economy after the worst recession in decades. Yet the recovery, especially in jobs, has been slow and economic growth stumbled this year, stoking expectations the Fed will act again.

But with economic data in recent weeks relatively better, and some central bankers worried that QE3 would have little benefit, nothing is certain.

One of the Fed's most prominent policy hawks, Charles Plosser of the Philadelphia Federal Reserve, warned that there is no point in launching another asset-buying program, in part because it risks future inflation.

"My current assessment both of the economy and the effectiveness of QE is that I don't think it really beats the cost-benefit test right now," Plosser said on CNBC.

Although Plosser said it is possible that QE3 could bring down interest rates somewhat, he warned that the massive cash reserves now on bank balance sheets could eventually drive up prices and hurt the economy.

"When those excess reserves ... begin to flow out into the economy, that's when the risk of inflation will become even more heightened than it is now," he said. "Right now it's just a risk."

DIALING BACK QE3 EXPECTATIONS

U.S. stocks fell and Treasury bonds rose on Thursday as traders slightly dialed back predictions that Bernanke will hint at QE3. The dollar, which has been pressured by the two huge easing programs in recent years, gained against the euro.

It is "likely that the vast bulk of (Bernanke's) speech will be devoted to examining past Fed actions, and any discussion of future actions will simply repeat recent official Fed communications," said JPMorgan economist Michael Feroli.

The U.S. jobless rate edged up to 8.3 percent last month, and recent data on business spending and inflation seemed to open the door to more policy action. But QE3 expectations have been tempered by a rebound in retail sales and jobs growth in July, a month in which nonfarm payrolls rose by 163,000.

The Labor Department will announce August jobs numbers next Friday.

Only 44 percent of fund managers now think the Fed will announce a third round of quantitative easing, down from 70 percent last month, according to a Reuters global asset allocation poll published on Thursday.

"Further stimulus, if we were to put that in place, would have some positive effect," Lockhart said, adding that he is not "overly concerned" about the longer-term costs of more action.

The policymaker argued it was possible for the Fed to push longer-term interest rates even lower than they already are, signaling that could be done by moving into the future the date the Fed has targeted for keeping overnight rates near zero.

On August 1, the central bank repeated that it expected to keep rates near zero at least through late 2014. Minutes from the meeting show that many Fed policymakers wanted to adjust the date at that time, but that the decision was put off to the September meeting.

TAKING STOCK, DRAWING LINES

Policymakers across the Fed's philosophical spectrum have drawn lines in the sand in recent days, with Chicago Fed President Charles Evans on one side calling for immediate QE3 and Richard Fisher of Dallas on the other saying nothing has been decided.

Sandra Pianalto of the Cleveland Fed - who like Lockhart is a centrist voter on Fed policy - said there are both benefits and limits to more easing.

Data on Thursday showed consumer spending rose the most in five months while the number of Americans filing new claims for jobless benefits held steady last week.

Lockhart said it was a good time to "take stock" in the performance of the U.S. economy.

Gross domestic product growth has been around 2 percent throughout the recovery, he said, calling it "very modest" and not "likely to make great progress in bringing down unemployment." Inflation has been "well behaved" near 2 percent, Lockhart noted.

Yosemite officials say 1,700 visitors risk disease

FRESNO, Calif. (AP) ? The rustic tent cabins of Yosemite National Park ? a favorite among families looking to rough it in one of the nation's most majestic settings ? have become the scene of a public health crisis after two visitors died from a rodent-borne disease following overnight stays.

On Tuesday, park officials sent letters and emails to 1,700 visitors who stayed in some of the dwellings in June, July and August, warning them that they may have been exposed to the disease that also caused two other people to fall ill.

Those four people contracted hantavirus pulmonary syndrome after spending time in one of the 91 "Signature Tent Cabins" at Curry Village around the same time in June. The illness is spread by contact with rodent feces, urine and saliva, or by inhaling exposed airborne particles.

After the first death, the park sanitized the cabins and alerted the public through the media that the cause might have been diseased mice in the park.

However, officials did not know for sure the death was linked to Yosemite or the campsite until the Centers for Disease Control determined over the weekend that a second visitor, a resident of Pennsylvania, also had died.

After every park tragedy, officials stress that Yosemite is a wilderness area and with it come some dangers.

"We're very concerned about visitors and employees," park spokesman Scott Gediman said. "But we feel we are taking proactive steps in both cleaning the affected areas and in public education. But it's absolutely impossible to eliminate all risk."

On Sunday night, health officials with the National Park Service sent out an alert asking public health authorities to be on the watch for more potential rodent-related cases of acute respiratory failure.

Yosemite receives 4 million tourists a year from around the world, and national park officials were trying to determine if the warning should be expanded to include foreign countries.

"We're discussing whether to do that and how to do that," said Dr. David Wong, chief of the epidemiology branch of the National Park Service Office of Public Health.

The disease can incubate for up to six weeks before flu-like symptoms develop. It's fatal in 30 percent of all cases, and there is no specific treatment. It is not spread human-to-human.

Wong said the Yosemite cases are unusual because hantavirus illnesses are most often isolated events.

"We are seeing more than one person who got it in a narrow space and time," he said. "It makes us wonder why, and those are questions we don't have the answers to."

All the victims stayed in the cabins between June 10 and June 20, and all four known cases were contracted by people who stayed within 100 feet of each other but not necessarily in the same cabins.

The National Park Service currently has assigned two epidemiologists to work in the park trapping rodents for testing. Additional studies are being done to determine if the Yosemite rodent population is higher than normal after a record snowpack in 2011 provided ample water for the grass seeds mice favor.

"Rodents and mice are native to the park, but we are looking at the populations and working with our wildlife biologists to determine if the population is too high," Gediman said. "There are rodents here, and we could never trap them all so that's not going to mitigate it."

As the Labor Day weekend approaches, some people have cancelled reservations at Curry Village after hearing about the outbreak, Gediman said.

The camp sits at the base of the 3,000-foot Glacier Point.

After boulders rained down in 2008, the park permanently closed some cabins. The newer, insulated Signature Cabins were built in 2009 to replace them. Investigators are trying to determine why those cabins were involved in the outbreak.

Park concessionaire Delaware North Co., which oversees the cabins, did not immediately return phone calls seeking comment.

Rangers are handing out information brochures at the park entrance warning people to avoid mice in general and mouse droppings in particular.

People with reservations in the affected cabins are not being notified before arrival, but they are being warned during check-in to report any sightings of mouse feces.

"This is a serious public health issue and we want to be transparent, but at the same time we don't want people to alter their plans, because we are taking the necessary precautions," Gediman said.

Since the first illness was reported earlier this month, employees of Delaware North disinfected all 408 canvas-sided and wood-sided cabins in Curry Village. Workers are in the midst of shoring up the cabins in an attempt to keep mice from have easy access.

Epidemiologists say none of the victims had anything in common other than staying in Yosemite cabins.

A 37-year-old man from the San Francisco Bay area was the first person to die. Further details have not been released because of medical privacy laws.

Of the 587 documented U.S. cases since the virus was identified in 1993, about one-third proved fatal.

Deer mice were determined to be the main carriers of the virus, though other rodents can be infected, according to the Centers for Disease Control. Most of the cases occur in the West, though researchers are not sure why.

This year's deaths mark the first such fatalities of park visitors, although two others were stricken in a more remote area of the park in 2000 and 2010.

There have been at least two other fatal cases in national parks in the past few years, including a deputy superintendent at Glacier National Park who died in 2004, and a tourist at the Grand Canyon who was stricken in 2009.

Wong said health officials never were able to determine whether the victims contracted hantavirus inside the park grounds.

Career ends for Clijsters with US Open loss

NEW YORK (AP) ? Not accustomed to losing the last point at the U.S. Open, Kim Clijsters picked up her bag, waved and bid adieu to the fans in Arthur Ashe Stadium ? summoning up a melancholy smile before making her way to the tunnel.

Her stay at her last professional tennis tournament ended much earlier than she'd expected. A winner of the last 22 matches she had played at the U.S. Open, Clijsters finally dropped one Wednesday, and with that loss ended a singles career that included four Grand Slam titles and thousands of good memories.

"It's been an incredible journey," Clijsters said, "and a lot of dreams for me have come true because of tennis."

She fell 7-6 (4), 7-6 (5) to 18-year-old Laura Robson of Britain to finish with a 523-127 record, 41 titles and 20 weeks ranked No. 1, most recently in February 2011.

Through the starts and stops of a career that spanned 15 years, Clijsters handled all the wins and losses with class, standing out as someone who could keep up with the powerful games and personalities that took over her sport ? and get people to like her while she was doing it.

"She was a tremendous athlete, a really good competitor," said Maria Sharapova, who won her match, 6-1, 6-0 over Lourdes Dominguez Lino. "I think the nicest thing you saw about her was her commitment to the sport, but also wanting to have a great family life, retiring from the sport to start that, and then coming back and achieving the things that she achieved."

Already with a U.S. Open title to her name, Clijsters walked away in 2007, but returned after getting married, having a baby and realizing she hadn't done everything she'd set out to do in her sport.

Now, she is nearing 30, her daughter, Jada, is 4, and it really is time to move on.

Earlier this year, she announced her last event would be the U.S. Open, the tournament she won in 2009 ? only months into her comeback ? and then again in 2010. Certainly, she didn't expect it to end in the second round, but knowing the end was coming one way or another, she said there were no regrets.

"Since I retired the first time, it's been a great adventure for my team and my family," said Clijsters, who was 28-0 against players ranked outside the top 10 at the U.S. Open before Wednesday. "It's all been worth it. But I do look forward to the next part of my life coming up."

Her last defeat at Flushing Meadows came against Belgian rival Justine Henin on Sept. 6, 2003, in the tournament final.

Robson was 9 at the time.

When it was over, one reporter asked the young British player: "Do you feel like the girl that shot Bambi?"

"I wouldn't go that far. I would say that was Becker beating Agassi here a few years ago," Robson said, referring to Benjamin Becker's four-set win at the 2006 U.S. Open that ended Agassi's career.

Robson knows, though, how much 23rd-seeded Clijsters means to the game, not only as a superb player but as someone who by all accounts is universally liked ? by fans, tennis officials and even opponents.

"She's always been someone that I've looked up to since I started on the tour. She's always been incredibly nice to be around," Robson said. "I think we're all going to miss her."

Clijsters was the only seeded woman who lost during the afternoon session of Day 3, when the winners also included No. 1 Victoria Azarenka, defending champion Sam Stosur, 2011 Wimbledon champion Petra Kvitova and 2011 French Open champion Li Na.

"The whole tour is certainly going to miss having her around. She's been a great player and a great person," Stosur said about Clijsters. "I guess she's ready to do other things. She's definitely one of those people that you can look up to and really admire with what she's been able to achieve."

In men's play, No. 3 Andy Murray, who won Olympic gold in singles and teamed with Robson for the silver in the mixed doubles, defeated Ivan Dodig of Croatia, 6-2, 6-1, 6-3 in a second-round match. No. 4 David Ferrer, No. 7 Juan Martin del Potro, No. 8 Janko Tipsarevic and No. 9 John Isner all advanced in first-round matches.

The headliner on this day, though, was Clijsters.

Less than an hour after her loss, she was hanging out in the players' garden alongside the stadium. She shared a laugh with some friends, hugs from others, and paused to pose for a photograph alongside 14-time major champion Serena Williams, who was headed out after partnering sister Venus for a first-round victory in doubles.

Clijsters is still in the doubles draw, paired with another Belgian, Kirsten Flipkens, and they play a first-round match Thursday.

Clijsters said she needed to focus on that. Clearly, though, the time to reflect has begun.

"It's not just the tennis side of things that you think about now, it's about life," she said. "We've had a lot of things happen in these last 15 years that I've been on tour. I'm able to look back at them, and I'm very happy with the progress that I've made."

If it?s August, it must be time once again for institutional money managers with assets of at least $100 million to update the Securities & Exchange Commission (SEC) on their stock holdings via Schedule 13F.

Back in May ? the last time shareholders were required to update their holdings ? I discussed David Einhorn?s new position in Computer Sciences (NYSE: CSC). When I wrote the article, the stock was trading for $26.67 per share and now trades at $33.02, a 23.8% gain in three months!

During the most-recent May-to-August period, 10 out of the 16 stocks highlighted (62.5%) made a profit (a sold stock is considered profitable if the stock went down in price). Making a profit is different from outperforming a stock index, however. Of the 12 stocks bought by the gurus, only four (33%) outperformed the S&P 500?s comparable gain of 8.1%. Of the four stocks sold, three (75%) underperformed the S&P 500, so the gurus were much better bears than bulls. Besides Computer Sciences, other nice winners were all Julian Robertson picks: Apple (NasdaqGS: AAPL) (17.1%), Sherwin-Williams (NYSE: SHW) (12.8%), and HCA Holdings (NYSE: HCA) (11.7%).

Ironically, of the four stocks highlighted from Seth Klarman?s portfolio, both stocks that he had purchased went down in value while the two stocks he had sold went up, which included the third-best performer of all in BP (NYSE: BP) (13.9%). Pathetic, no?

To be perfectly frank, Seth Klarman really stunk out the joint this quarter, underperforming the S&P 500?s 8.1% gain by a wide margin. This is very unusual because Klarman is considered one of the best value investors of all time. Nevertheless, Klarman?s recent fascination with biotech stocks and gold mining stocks ? two industries that his classic investment book Margin of Safety would classify as speculations rather than investments ? have really done him in. In the first quarter, biotechs Targacept (NasdaqGS: TRGT) and Idenix Pharmaceuticals (NasdaqGM: IDIX) were huge losers for Klarman and he followed those disasters up by buying more Idenix only to see it perform even worse in the second quarter than it did in the first!

Lesson to be learned: don?t follow Klarman?s lead on biotech and gold, but follow him on virtually everything else!

Two other of the superstar investors (Robertson and Einhorn) also had at least one really bad trade. To summarize the losers:

  • Seth Klarman?s Idenix Pharmaceuticals (NasdaqGM: IDIX) (down 35.6%) and NovaGold Resources (NYSE: NG) (down 21.1%)
  • Julian Robertson?s Starbucks (NasdaqGS: SBUX) (down 12.8%)
  • David Einhorn?s General Motors (NYSE: GM) (down 1.2%)

Ironically, the one superstar investor who didn?t pick a single losing stock ? Chuck Akre ? was also the only one of the four gurus that didn?t have a single stock outperform the S&P 500.? All the other gurus outperformed on at least one of the four stock picks (if you include stocks sold that underperformed the S&P 500). So, I can?t praise Akre despite his lack of losers. The only two gurus worthy of praise are David Einhorn and Julian Robertson because they each outperformed the S&P 500 on three out of their four stock picks. Just goes to show you that mindlessly piggybacking on anybody else?s picks without doing your own research is no sure-fire way to beat the market.

Nevertheless, these quarterly SEC filings are a gold mine of information as to what the smartest investors are buying and selling. A timely review of them can make you money. With that in mind, I thought I would vet the most recent set of SEC filings to see if there are any more hidden gems ready to make big moves.

In my May update of Q1 2012, I removed Bill Ackman despite being the best performer in Q4 2011 because he didn?t trade much in the first quarter, but his trading has picked up again and I want him back. This means one of the current four ?superstar investors? has to go. Of the two worst performers this time around ? Seth Klarman and Chuck Akre ? I?m getting rid of Akre because, well, Klarman is a legend and untouchable.

I don?t list all guru transactions, just ones that I personally find noteworthy. If you also have a voyeuristic streak in you, read on.
